These terms govern your use of this website. They are not our engagement agreement — advisory work is covered by a separate signed contract.
These Terms of Use ("Terms") govern your access to and use of www.kevinharrilal.com and any pages, forms, or communications we make available through it (together, the "Site"). The Site is operated by Harrilal Enterprises LLC, a Florida limited liability company with its principal place of business at 408 NE 6th Street, Fort Lauderdale, FL 33304 ("Harrilal Enterprises," "we," "us," or "our").
By visiting the Site or submitting information through it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
You must be at least 18 years old and able to enter into a binding contract. If you use the Site on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.
Everything on the Site is general business information published for prospective clients. It is not legal, tax, accounting, investment, financial, or other professional advice, and it is not a substitute for advice from a licensed professional who understands your specific circumstances.
Nothing on the Site should be read as a promise or prediction of results. Business outcomes depend on facts we do not know until we work together, and past engagements do not indicate what any other business will achieve.
Do not act, or decline to act, on the basis of anything on this Site without obtaining professional advice suited to your situation.
Using the Site, submitting the contact form, or exchanging emails, calls, or texts with us does not create an advisory, fiduciary, agency, or contractual relationship between us. An engagement begins only when both parties sign a written engagement agreement that sets out scope, deliverables, and fees.
Please do not send confidential or sensitive information through this Site. Until an engagement agreement is signed, anything you send us is not treated as confidential or privileged, and we may already be advising other businesses in your industry.

You keep ownership of what you send. You grant us a non-exclusive, royalty-free license to use, store, and reproduce it as needed to respond to you, evaluate a possible engagement, and operate our business, as described in the Privacy Policy.
When you submit the contact form, you agree that we may contact you at the email address and phone number you provide in order to respond to your inquiry, including by email, phone call, and text message. These are transactional messages and continue regardless of your marketing preferences until your inquiry is closed.
We send marketing emails and texts only to people who separately and affirmatively opt in by checking the marketing box on our form. Your consent to marketing messages is not a condition of any purchase, service, or engagement.
Message frequency varies and will not exceed 4 messages per month. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for assistance. You can unsubscribe from marketing emails using the link in any marketing email. We honor opt-out requests promptly. Mobile carriers are not liable for delayed or undelivered messages.
You consent to receive notices and disclosures from us electronically, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any part of the Site without our prior written permission. Nothing on the Site grants you any license or right to use our trademarks or trade dress.
The Site may link to third-party websites and may rely on third-party services to deliver forms, email, and hosting. We do not control those sites or services and are not responsible for their content, security, or practices. Your use of them is governed by their own terms and privacy policies.
We do not guarantee that the Site will be available without interruption or error. We may change, suspend, restrict, or discontinue any part of the Site at any time without notice, and we may limit or terminate your access if we believe you have violated these Terms.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This section applies to the Site only. Our liability for advisory services is governed exclusively by the signed engagement agreement covering that work. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify, defend, and hold harmless Harrilal Enterprises and its owners, officers, employees, and contractors from any claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and Harrilal Enterprises agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Broward County, Florida, and both parties consent to personal jurisdiction and venue there.
Optional: if you would prefer disputes resolved by binding arbitration rather than in court, a separate arbitration and class-action-waiver clause should be added here. That is a meaningful business decision — discuss it with your attorney before adding it.
We may update these Terms from time to time. The revised version takes effect when posted, and the "Last updated" date above will change. If the changes are material, we will make a reasonable effort to highlight them. Your continued use of the Site after a change means you accept the revised Terms.
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site, and they supersede any prior understandings about it. Section headings are for convenience only.

What we collect when you use this site, why we collect it, and how you can control it.
This Privacy Policy explains how Harrilal Enterprises LLC ("we," "us," or "our") collects, uses, shares, and protects personal information through www.kevinharrilal.com and our related email and text communications (the "Site").
It does not cover information you give us in the course of an active engagement. That information is governed by the confidentiality terms of your signed engagement agreement, which control if there is any conflict with this policy.
When you submit the contact form, we collect your full name, email address, and phone number, along with anything you write in the message field and whether you opted in to marketing. We also record the date and time of your submission and the fact that you consented, so we can demonstrate that consent later.
If you email, call, or text us directly, we keep the contents of that correspondence and your contact details.
Our hosting provider and any analytics we use may automatically record your IP address, browser type and version, device type, operating system, referring page, the pages you view, and the dates and times of your visits. We may infer approximate city-level location from your IP address. We do not collect precise GPS location.
We do not intentionally collect Social Security numbers, driver's license numbers, financial account or payment card numbers, health information, biometric data, or precise geolocation through the Site. Please do not submit these through our forms.
Cookies are small files stored by your browser. The Site currently uses only cookies strictly necessary to operate and secure it — specifically a single session cookie that holds an anti-forgery token for the contact form. It contains no personal information and expires when you close your browser. Update this section if analytics or advertising pixels are added.
You can block or delete cookies through your browser settings, though parts of the Site may not work correctly if you do. If we later add analytics or advertising technologies such as Google Analytics or the Meta pixel, we will update this section and, where required, provide a consent banner before those technologies load.

We send marketing messages only to people who checked the marketing opt-in box on our contact form or otherwise gave express written consent. Opting in is never required to contact us, to receive a proposal, or to become a client.
We do not sell, rent, lease, or share mobile phone numbers, text messaging originator opt-in data, or consent records with any third party or affiliate for their own marketing purposes. This information is used solely by Harrilal Enterprises to send the messages you asked for.

Every marketing email includes an unsubscribe link and our physical mailing address, as required by the CAN-SPAM Act. We process unsubscribe requests promptly and within ten business days at the latest.
We add you to a suppression list so you are not contacted again in error. We may still send you transactional messages — replies to a question you asked, scheduling confirmations, or information about an active engagement.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only in these circumstances:

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of the Site in transit (HTTPS), access controls, and limiting access to people who need it. No website or method of transmission is completely secure, and we cannot guarantee absolute security. Please do not send sensitive information through the Site's forms.

We may need to verify your identity first, and we may keep information where a legal obligation requires it — including your suppression record, which we retain specifically so we do not contact you again.
Exercising these rights is free, and we will not discriminate against you for doing so.
Several U.S. states give residents specific privacy rights. Most of those laws apply only to businesses above certain revenue or data-volume thresholds, and we may not currently meet them. We honor the requests described in the section above from anyone who asks, whichever state they live in.
If you are a resident of California, Colorado, Connecticut, Virginia, Texas, Oregon, Florida, or another state with a comprehensive privacy law, you may have rights to access, correct, delete, or obtain a portable copy of your personal information, and to opt out of sale or targeted advertising. As noted above, we do not sell personal information or use it for targeted advertising. To make a request, or to appeal a decision we made about a request, contact us using the details below.
The Site is intended for business owners and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has submitted information to us, contact us and we will delete it.
Browsers can send a "Do Not Track" signal, but there is no common industry standard for how to respond to it. The Site does not currently respond to Do Not Track signals. We do not track you across other websites.
We operate from Fort Lauderdale, Florida, and our service providers are primarily located in the United States. If you access the Site from outside the U.S., your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country. By using the Site, you consent to that transfer.
We may update this policy as our practices or the law change. The revised version takes effect when posted, and the "Last updated" date will change. If we make a material change to how we use information you already gave us, we will notify you by email before it takes effect where required.
